Terms and conditions

Scope

These terms and conditions apply to the relationship between Minh Luong (hereafter Minh Luong, seller or we / us) as seller and you as customer when orders are placed on the Minh Luong website (hereafter our website) or in person or via email.

Conclusion of a contract

If an order is placed for an item that is out of stock, you shall be notified by email. No contract shall be concluded. If you wish us to do so, we will try our best to provide you with an alternative and/or to update you as to the availability status of the items you originally selected.

Prices

The prices and information indicated for an item at the time of order on our website apply to the transaction. Payments are made at checkout in Swiss Francs. All prices on our website are without VAT. For international orders, it is most likely you will be charged your local VAT upon delivery as well as other import duties.

The prices for the gemcutting services shall be provided in a quote/invoice upon the customer's request.

Terms of payment

Payments usually occur via credit card (via Shopify Payments which is processed by Stripe), directly on our website.

Other available payment methods are Paypal, Amazon Pay, Apple Pay, and Google Pay.

We also offer payment in advance via bank transfer. When using such payment method, the payment must be made to our bank account in Swiss Francs. The usual payment term is 14 days. If we have not received payment within this period, we reserve the right to cancel the order and release the goods again for sale.

As for the payment of gemcutting services, the invoice must be settled in full via bank transfer or in cash upon delivery of the order.

Pre-order

Minh Luong offers pre-orders. This allows us to produce more accurate quantities, avoid unnecessary waste and optimise production. 

Pictures for such pre-orders are based on prototypes and samples, both when it comes to colour and style. Although the final piece will be very close to what you can see on our website, they may differ slightly (optimisation, gemstone colour, etc.).

Our return policy also applies to pre-ordered items.

Gemcutting services

Minh Luong offers gemcutting services. Upon the customer's request and examination of the gemstones, a quote/invoice shall be sent by email.

All gemstones may be delivered to Minh Luong in Geneva, Switzerland in person or at the customer’s risk via courier service or registered mail or other means of transport at the election of the customer. Any and all gemstones sent to Minh Luong shall be insured by the customer to their full value, such insurance covering the delivery to Minh Luong, the time period during which the gemstones are in Minh Luong's possession and the return of such gemstones by Minh Luong to the customer. The customer is solely responsible for and shall arrange the completion of all formalities with respect to the import and export of gemstones into and out of Switzerland and the payment of all import and other duties. Minh Luong shall not accept any gemstones for which import, export and customs formalities have not been completed.

Minh Luong does not guarantee the performance of the gemcutting services by any specific date. Orders will, however, under normal circumstances be completed by Minh Luong within 4 to 6 weeks after the receipt of the order. If this is not possible, Minh Luong will inform the customer.

Minh Luong accepts no responsibility for any losses or damages of any kind that may occur as a result of the gemcutting work. Despite all due caution, the mechanical work of gemcutting may cause the gemstones to react unpredictably. 

The customer agrees to having Minh Luong's works, including, but not limited to handling, testing, analysing, unmounting and mounting of the gemstones, done by subcontractors or other auxiliaries.

Minh Luong is not liable for any loss of or damages to the gemstones due to negligent or willful behaviour of a subcontractor or other auxiliaries, including loss or damages resulting from the shipment of items by professional shipping companies. 

Minh Luong accepts no return or refund for gemcutting orders. Since all gemcutting services are custom-made, our return policy does not apply to such orders. 

Care

We highly recommend to follow the care instructions for each product. This will ensure you may use your item to its fullest, when it comes both to style and durability. We do not assume any liability for faulty care on the part of the customer.

Minh Luong is committed to process your customer data with diligence and meet the requirements of the relevant data protection legislation. Kindly refer to our privacy policy to get a full picture of how we handle your data.

Marketing

Provided you opted in during checkout, subscribed to our newsletter or got in touch with us through the dedicated form, we may send you marketing emails. You may of course opt out at any time and/or send us feedback at minh@minhluongjewellery.com.

Amendments to the terms and conditions

Minh Luong reserves the right to change the present terms and conditions at any time and without notice (in particular for the sake of our dear customers’ inboxes). The version available online at the time the order is placed applies to such order.

Applicable law/place of jurisdiction

The relationship between you and Minh Luong is subject to Swiss law. Unless provided differently under compulsory consumer regulations, the place of jurisdiction shall be Geneva, Switzerland.
